WHY AM I RECEIVING THIS PRIVACY POLICY?
Allied Universal Security Services (“Allied Universal,” “Company,” “we,” “us,” or “our”) is enabling you to access the Mercury Personal Edition application (“MPE App” or “App”) through both the Google Play and Apple iOS App Stores and to download and use the MPE App on your personal smart phone. This use of the MPE App is for your convenience and to further enhance the safety of our employees in the field and expand access to your schedule and additional work opportunities.
Using the MPE App on your personal phone allows the Company to collect certain personal information about you. This MPE App Privacy Policy (“Policy”) describes the types of personal information we may collect about you while using the MPE App and how we collect, use, maintain, protect, and disclose that personal information. To use the MPE App on your personal phone, you must agree to this Policy.
WHAT AM I AGREEING TO?
By accepting this Policy, you agree that the Company can collect and use your personal information as described in this Policy. Also, you agree to the other conditions required by the Company to use the MPE App on your personal phone.
The MPE App collects and uses your personal information as described below but does so only while you are logged into the MPE App. The personal information collected is used to enable the use of and improve the MPE App’s features and functionality. By accepting this Policy, you agree to the collection of your personal information as described below MPE App as described in this Policy.
Please read this Policy carefully. This Policy is updated from time-to-time. Each time it is updated, we require you to review and agree to the updated version of the Policy to continue using the MPE App. So, please check this Policy regularly for updates.
WHAT HAPPENS IF I DO NOT AGREE TO THIS POLICY?
If you do not agree to this Policy, you will not be able to use your personal phone to receive notices of open shifts via your personal phone, which may delay or prevent your ability to accept additional work opportunities. You also will not be able to use your phone to request to talk to a manager, check your schedule. or update your personal information with the Company, using this App. You will still be able to do all these things but not with the convenience that comes with using the MPE App on your personal phone.

WHAT DOES THE MPE APP ALLOW ME TO DO?
The MPE App allows you to do the following:
1. MPE App registration;
2. login/logout;
3. receive notices of open shifts and additional work opportunities;
4. view and update your contact information;
5. talk to a manager; and
6. view your schedule and send it to your personal email address.
WHAT PERSONAL INFORMATION DOES THE MPE APP COLLECT THROUGH MY PERSONAL PHONE?
A. When I register to use the MPE App or log in to the MPE App after registering?
As part of your employment with the Company, you voluntarily provided us with certain personal information that we store in the Company’s systems. To validate your identity and status as an active Company employee, the MPE App may ask you to enter personal information that is compared to your personal information in the Company’s systems, including, your name, email address, telephone number, the IP address of your phone, last six-digits of your Social Security Number, date of birth, physical address, and employee identification number.
For security purposes, you will be required to create and use a password and another form of verification (two-factor identification). Some phones have biometric verification features. The MPE App also will allow you to use the biometric verification features on your phone, like fingerprint and facial recognition, as a form of identity verification. The Company does not have access to any of that biometric information and does not collect it.
B. When I am logged out of the MPE App?
Even when the location service in your phone’s operating system is “turned on” for the MPE App, the application does not collect or transmit any location data or other personal information from your phone, its operating system, or native or installed apps on your phone while you are logged out of the MPE App.
C. Does the MPE App collect other personal information that could be used to identify me?
When you are logged into the MPE App, the App and Company servers may collect other information for security and communication purposes. For example, the MPE App may capture technical information about your internet connection, the hardware and software you use to access the MPE App, your device identification number, IP address, operating system, page views, clicks, and other communication information that does not directly identify you personally. While the Company does not use that information to identify you, it is possible for this information to identify you if combined with other information about you.
WHAT INFORMATION DOES THE MPE APP STORE ON MY PERSONAL PHONE?
The MPE App only stores a GUID (globally unique identifier) on your phone. The GUID is used to verify that your phone is registered to use the MPE App. The MPE App does not access metadata and other information associated with files stored on your device. However, if you upload files to the MPE App, like a photograph, that data will be stored on the Company’s computer servers that support the MPE App.
WHAT PHONE PERMISSIONS/SETTINGS DO I HAVE TO “TURN ON” TO USE THE MPE APP?
Location Services – To use the MPE App, you simply have to download the app and follow the prompts to register it with the Company, then log in. You do not need to enable your phone’s location services. Even if you do, the MPE does not collect or transmit your location information to the Company.
HOW DO WE USE OR DISCLOSE YOUR PERSONAL INFORMATION WE COLLECT?
We may use your personal information:
• to fulfill the MPE App functionality as described in the user guides and this Policy;
• to carry out our contractual or legal obligations and enforce our rights arising from services provided to our clients;
• to manage and administer our relationship with you and contact you regarding our relationship;
• to enhance the App, optimize performance, repair, and develop improvements to the App that better meet our clients’ needs;
• for legitimate business purposes, like record keeping and App administration; and
• in any other way we may describe when you provide the information, or for which you provide consent.
We may disclose your personal information to:
• our subsidiaries and affiliates;
• contractors, service providers, and other third parties who support our business operations (e.g., payment processors, hosting providers, and other business consultants) who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;
• a successor company in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets;
• any other entity disclosed by us when you provide the information, or for which you provide consent; or
• comply with any court order, law or legal process, including to respond to any government or regulatory request, to enforce or apply the MPE App policies and other agreements, or if we believe disclosure is necessary or appropriate to monitor and maintain our computer network and IT assets and to protect our rights, property or your safety and that of other individuals and clients. This includes exchanging information that may contain your personal information with other companies, organizations, regulators and enforcement authorities for the purposes of fraud protection, and in connection with investigations into suspected violations of applicable law or Company policies.
We may transmit your personal information over international borders to provide access to subcontractors and vendors located outside the U.S. as necessary for providing our services in accordance with our standard business practices and this Policy, and we will maintain reasonable security policies regardless of where your personal information is stored or processed.
HOW DO WE PROTECT YOUR PERSONAL INFORMATION?
We have implemented at least industry standard measures designed to prevent any unauthorized access to or unauthorized, use, alteration and disclosure of your personal information. We encrypt data when it is stored on Company systems and within the MPE App.
Unfortunately, the transmission of information via the internet or cellular service is not completely secure, so we cannot guarantee the security of your personal information transmitted via the MPE App. Regardless, you should follow the Company’s information security policies, including those on the use of public WIFI networks.
The safety and security of your information also depends on you. You are responsible for keeping your username, password, and any other login credentials or user verification information confidential. You may not share that information with anyone. To protect you and your data and that of our other users, we may suspend your access to the MPE App without notice, pending an investigation, if any breach of security is suspected.
Other than to facilitate your normal job functions, your personal information from the MPE App will not be accessible to your direct managers or supervisors absent a suspected violation of the Company’s Code of Ethics or policies.
WHAT ARE MY RIGHTS REGARDING MY PERSONAL INFORMATION?
We store the information collected through use of the MPE App until the business purpose for which it was collected has been satisfied. If you would like to access, correct, or limit the use or disclosure of your personal information, you may do so by updating your employee profile or submitting a request form here. HOW DOES USING THE MPE APP AFFECT YOUR ROLE AT WORK?
Employees who opt to use their personal devices for work are still subject to the Company’s policies concerning harassment, discrimination, retaliation, trade secrets, confidential information, and ethics, and should not engage in communications or conduct that violates this Policy and any other relevant Company-issued notices and policies.
Likewise, your use of the MPE App is subject to the Company’s policies, workplace rules and other applicable notices and policies regarding monitoring and acceptable use of devices that connect with the Company’s information and communication assets, as applicable. Please see the Company’s Code of Ethics, your Employee Handbook, MPE App Privacy Policy and employee privacy policy for additional information about the rules that apply to your use of the MPE App.
You are never expected to monitor or use your personal device to perform work-related tasks during off-duty meal periods or rest breaks or when not on duty. Further, any time spent using a personal mobile device for compensable tasks (even if outside of scheduled hours) must be recorded for timekeeping purposes. You should avoid conducting work-related business on your personal devices outside of scheduled work hours, unless directed otherwise by a supervisor.
When using your personal devices for work, you are also expected to follow all applicable local, state, and federal laws and regulations at all times, including those that apply to the use of hands-free devices while driving. If you are charged with traffic violations resulting from the use of your personal cell phones or devices while driving, you will be solely responsible for all liabilities that result from such actions. In addition, if you work in hazardous areas, you must refrain from using personal devices while at work in those areas, if such use can potentially be a major safety hazard.
The Company will not be responsible for the loss or damage of your personal cell phone. You are responsible for the cost of repair or replacement.

WHY AM I RECEIVING THIS PRIVACY POLICY?

Using the Enhanced MPE App on your personal phone allows the Company to collect certain personal information about you, including, at times, your real-time geographic location. This Privacy Policy (“Policy”) describes the types of personal information we may collect about you while using the Enhanced MPE App and how we collect, use, maintain, protect, and disclose that personal information. To use the Enhanced MPE App on your personal phone, you must agree to this Policy.
What Am I Agreeing To?
By accepting this Policy, you agree that the Company can collect and use your personal information as described in this Policy. Also, you agree to the other conditions required by the Company to use the MPE App on your personal phone.
The Enhanced MPE App collects and uses your personal information as described below but does so only while you are logged into the Enhanced MPE App. Importantly, the Enhanced MPE App collects your phone’s real-time location information at regular intervals and transmits the phone’s location information to Company servers while you are using the “clock-in” feature at the jobsite. The App will continue to collect your phone’s location information until you “clock-out” in the App, even if you leave the jobsite. How your activation of the clock-in and clock-out features control the Company’s collection of your phone’s real-time location information is described later in this Policy. Regardless, the phone’s location and other personal information collected is used to enable the use of and improve the Enhanced MPE App’s features and functionality.

Certain client accounts/jobsites require use of the Enhanced MPE App for purposes of validating your time and attendance. If you do not agree to use the Enhanced MPE App as described in this Policy, you will not be permitted to work on those client accounts/jobsites. However, you can seek another assignment with the Company that does not require the use of the Enhanced MPE App, and the Company will work to find you another position for which you are qualified. You may also use the basic version of the MPE App in accordance with that version’s Privacy Policy.

WHAT DOES THE ENHANCED MPE APP ALLOW ME TO DO?
The Enhanced MPE App allows you to do the following without using your phone’s location information:
7. MPE App registration;

9. receive notices of open shifts and additional work opportunities;
10. view and update your contact information;
11. talk to a manager; and
12. view your schedule and send it to your personal email address.
In addition if your phone’s location service is “turned on” for the Enhanced MPE App and you are inside the geofence at your assigned jobsite (described in the next section), you can use the Enhanced MPE App to clock-in/clock-out, including for unpaid breaks. Once clocked-in, the following features are available while inside the geofence at your assigned jobsite:
1. view post orders for the site you are assigned to work;
2. obtain a driver QR code Lytx for jobs that require driving;
3. complete tasks maintained on your “to do” list, such as reading Company announcements and completing certain compliance tasks; and
4. receive and respond to messages from your supervisor/the Company.
5. receive and respond to chats from your supervisor/the Company.
HOW AND WHEN DOES THE ENHANCED MPE APP COLLECT AND USE MY PHONE’S LOCATION?
The Enhanced MPE App uses the global positioning system (GPS) technology in your phone to detect your location at regular intervals (approximately every 5 mins) under the conditions described in the next paragraph. A “geofence” is a virtual geographic boundary around your jobsite, defined by GPS, that enables the Enhanced MPE App to detect and send your location through your personal phone to Company systems.
The Enhanced MPE App will collect your location only if all the following conditions are met:
1. you have been approved as an enhanced user of the App;
2. you are using the personal phone you registered with the Company’s systems for use with the App;
3. your phone’s location service setting is turned “on” or “enabled” for the App in the phone’s operating system settings;
4. you are logged into the App inside your jobsite’s geofence; and
5. you are “clocked in” through the App for your shift while you are inside your jobsite’s geofence.
Importantly, if you do not clock-out before you leave your assigned jobsite, the Enhanced MPE App will continue collecting your location information outside the jobsite geofence until you clock-out through the Enhanced MPE App.

D. When I register to use the Enhanced MPE App or log in to the MPE App after registering?

If you have been approved by the Company to use the Enhanced MPE App, you can use the geofenced electronic timekeeping feature to clock-in, so long as you are logged in to the App and you are inside the geofence of your assigned jobsite. When you use the clock-in feature inside the jobsite’s geofence, the Company’s timekeeping system will collect real-time location information, including your phone’s IP address, through the Enhanced MPE App. The Enhanced MPE App continues to collect real-time location information at regular intervals (typically, every 5 minutes), even if you are outside the jobsite geofence, and the App will continue to collect your phone’s location information until you clock-out using the App.
While you are clocked into the Enhanced MPE App inside your assigned jobsite’s geofence, you also will be able to access other location-dependent tasks, like completing your “To Do List.” We also may offer clients an option to use your approximate clock-in location based off an IP address for time and attendance recordkeeping purposes. Regardless, you also must stay clocked-in via the MPE App during your shift for the location features to work properly.
E. When I am logged into the Enhanced MPE App but I am using it outside the jobsite’s geofence?
You may still use the Enhanced MPE App for general functions like, searching for available shifts, but you will not be able to use location dependent services like electronic timekeeping. Also, the Enhanced MPE App will not send your location data to Company systems, nor will it track your location, unless you fail to clock-out of your shift through the App.
F. When I am logged out of the Enhanced MPE App, regardless of my phone’s location?
Even when the location service in your phone’s operating system is “turned on” for the Enhanced version of the MPE App, the application does not collect or transmit any location data or other personal information from your phone, its operating system, or native or installed apps on your phone while you are logged out of the MPE App.
G. Does the Enhanced MPE App collect other personal information that could be used to identify me?

WILL THE COMPANY COVER THE COST OF USING THE ENHANCED MPE APP ON YOUR CELL PHONE?
The Company will not provide an expense reimbursement to employees that use the Enhanced MPE App and have not been approved to use the Enhanced features.
For employees approved to use the Enhanced MPE App, AUS will provide an expense reimbursement stipend of Five Dollars ($5.00) per month to you for the use of your personal cell phone. This stipend is intended to cover the monthly expense associated with the proportionate business use of your cell phone. If you do not believe this stipend covers the business use of your personal device in any month, you must contact Human Resources and provide documentation substantiating that the monthly business use of the device exceeds Five Dollars ($5.00). Are we sure the $5 amount is settled? We discussed basing this on actual usage and prorating the reimbursement.
HOW DOES USING THE ENHANCED MPE APP AFFECT YOUR ROLE AT WORK?
